Regulatory & Standards Issues Working Group

Working Group Activities:

  • Continue to encourage Brazilian regulators to conduct public consultations and to allow for reasonable comment periods before implementing new technical regulations.
     
  • Work toward implementation of Brazilian policies consistent with multilateral obligations and international best practices under which all mandatory requirements, particularly those promulgated by regulatory and procurement agencies, are developed in a consistent manner, allowing for increased transparency, predictability, regulatory effectiveness, and private sector participation in Brazilian democracy.
     
  • Working in partnership with the American National Standards Institute and the National Institute of Standards and Technology, continue to promote increased implementation of existing U.S. policies which require U.S. regulators and procurement agencies to consider using private sector standards and conformity assessment mechanisms before creating government unique requirements.
     
  • Consistent with multilateral obligations and international benchmarks of good regulatory practice, continue to build confidence with U.S. and Brazilian regulators, encouraging them to use international standards and conformity assessment mechanisms wherever practicable as the best means of accomplishing regulatory objectives while minimizing unnecessary and negative impacts to trade and economic growth.
     
  • Further a public-private dialogue with ANVISA, FDA and the private sectors of both countries to discuss mechanisms to increase the alignment and rationalization of disparate agency requirements, including those related to facility inspections.
     
  • Further a public-private dialogue with ANATEL, FCC and the private sectors of both countries to minimize costs related to duplicative testing and certification of telecommunications equipment.
